Here is an interesting dilemma I faced today: Landlord is in default of mortgage and a foreclosure proceeding is instituted against Landlord. What should Tenant do? Pay Landlord or Bank? Landlord, if the property is still in Landlord's name, may institute a non-payment summary proceeding against Ternant if Tenant withholds rent. But if the Bank or foreclosure court notifies Tenant to pay someone else, what does Tenant do? What are Tenant's rights?
