Defendant's motion to dismiss pursuant to CPLR 3211 (a) (1), (5) and (7) is granted in its entirety. Provided that no timely appeal is taken, defendant's motion to cancel the notice of pendency pursuant to CPLR 6514 (a) is granted and the Kings County Clerk is directed to cancel the notice of pendency thirty days from the date a copy of this order is served upon plaintiff.
